Can I use a 160GB drive to swap out the orginial drive on my Series 2 TCD24004A? I dont think that that has the LBA48 kernel.
If I can't use it, could I just use it and have the Tivo only recognize 137GB??

You can use it, but only 137GB will be recognized.

That's what I thought. And theoreticly if/when a new kernel comes out I should be able to just apply the new kernel and get the extra space then?

Theoretically, if a new kernel comes out for this model (haven't heard anything to that effect), there would be a new version of InstantCake to support it. You wouldn't just be able to install the kernel; the software would need to be reconfigured to make use of the additional space.

Best not to theorize as there are a lot of factors, and attempting to simplify things will actually make them more complicated.
